Understanding Workers' Compensation Income Benefits

In addition to medical benefits, you are entitled to receive weekly income benefits as a part of your workers' compensation settlement. Baton Rouge wage loss benefits attorney Brian D. Calvit can help. Louisiana workers' compensation laws define four categories of wage loss benefits that are available for those who have suffered serious injuries in the workplace.

  • Temporary total disability (TTD) benefits: If you are totally disabled and unable to work for some time, these benefits provide weekly income equal to two-thirds of your average weekly wage. Generally benefits are provided indefinitely until you return to the workforce or you have reached maximum medical improvement.
  • Permanent partial disability (PPD) benefits: These benefits are available for those who may not require much time off work for recovery but have suffered permanent or disfiguring injuries such as hearing loss, blindness, amputation, significant scarring, internal injuries or other catastrophic injuries.
  • Supplemental earnings benefits (SEB): If your injury or illness prevents you from earning at least 90 percent of the income that you were receiving prior to your accident, you may be eligible for SEB. These benefits are equal to two-thirds of the difference in the average weekly wage of what you were making before your accident and what you are now earning or capable of earning.
  • Permanent total disability (PTD) benefits: If you are unable to perform any type of job following your accident, PTD benefits provide weekly income benefits for life or until you return to employment. The court will make the final determination based on evidence provided by your treating physician and testimony provided by vocation rehabilitation expert.

If you qualify for Social Security Disability Insurance (SSDI) benefits, we will coordinate your workers' comp benefits to minimize any negative impact to your settlement. While we do not handle SSDI claims, we can provide referrals to qualified legal professionals who do.

Other Forms of Compensation

The Louisiana Workers' Compensation Act also provides compensation for specific illnesses that may be directly related to the type of work you do. This includes occupational injuries such as carpal tunnel syndrome, asbestos-related injuries, toxic exposure resulting in cancer, and others. The laws governing these benefits are highly specific and complex, so having an experienced lawyer on your side is crucial to pursuing compensation.

If your loved one was the victim of a fatal workplace accident, your family may also be entitled to seek survivors' benefits to assist with the loss in financial stability your loved one provided.
